Acceptable Use Policy

STAR-TECH IT SOLUTIONS INC. and its affiliates (“Service Provider”) have created this Acceptable Use Policy (“AUP”) to promote responsible use of its networks, systems, website, products, services, and solutions, including VoIP services powered by the SkySwitch platform (collectively, the “Services”), by our customers and their End Users (collectively, “Users”). This AUP applies to all Users, as defined in the Service Agreement. If you have a Service Agreement, including any Order or Letter of Authorization (LOA), with Service Provider, this AUP is incorporated into and used in conjunction with those terms. Additional service-specific terms may apply, as outlined in the Service Agreement or LOA. In case of conflict between the Service Agreement and this AUP regarding governing law, warranties, or disclaimers, the Service Agreement prevails. By accessing or using the Services, all Users agree to be bound by this AUP.
Service Provider reserves the right to modify this AUP at its discretion, with modifications effective upon posting to https://startechitsolutions.com/acceptable-use-policy. Continued use of the Services after such modifications constitutes acceptance of the updated AUP.
Prohibited Conduct
Services may only be used for lawful purposes. Users are responsible for all transmissions sent, received, posted, accessed, or stored using the Services, including the content of any communication, whether authorized or not. Transmitting, distributing, or storing material that violates federal or state laws, regulations, or industry standards is prohibited. Users may not:
Attempt to gain unauthorized access to data, accounts, hosts, servers, systems, or networks, or relay communications through third-party servers without authorization.
Probe, scan, or test the vulnerability of Service Provider’s system or network without prior written consent.
Interfere with the Services or another User’s use of the Services.
Infringe intellectual property rights, including copyrights, trademarks, patents, trade secrets, or other proprietary rights.
Violate rules, regulations, or policies of third-party networks, servers, or databases accessed through the Services.
Disseminate or post material that is unlawful, libelous, defamatory, obscene, indecent, explicit, lewd, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory, or otherwise objectionable.
Offer or disseminate fraudulent goods, services, schemes, or promotions (e.g., pyramid schemes).
Disseminate harmful content, including Trojan horses, worms, time bombs, zombies, cancelbots, or other malicious programming routines that may damage, interfere with, intercept, or seize any system, program, data, or personal information.
Engage in email spamming or mailbombing, including: (a) unsolicited advertisements, commercial emails, or promotional messages; (b) unsolicited informational announcements; (c) chain mail; (d) numerous copies of similar messages; (e) empty messages; or (f) large messages or files that disrupt servers, accounts, newsgroups, or chat services.
Violate email, telemarketing, or telecommunications laws, such as the Telephone Consumer Protection Act (TCPA), FCC robocall regulations, or E911 requirements, or use the Services in a manner that negatively affects the network or service delivery (e.g., mass dialing, pre-recorded calls, overloading servers, violating caller ID regulations, or generating excessive third-party complaints).
Upload, post, or distribute emails containing viruses, corrupted files, or other harmful software.
Use forged, false, or misleading number identities, email headers, or invalid domain names, or employ techniques to hide or counterfeit the source of emails or postings.
Engage in auto-dialing or predictive dialing (“robocalling”) on trunks not designated for such use.
Continuously or extensively engage in chat line or conference call participation.
Use free conference calling or similar services that Service Provider deems to involve traffic stimulation or excessive charges.
Use an open telephone line for monitoring, intercom, or similar services.
Repetitively or continuously message or call the same destination or number if such activity provokes or is likely to provoke complaints.
Make long-duration calls (exceeding four continuous or cumulative hours in a 24-hour period to the same number) or calls to specific numbers for the purpose of generating charges for a third party.
Use voice Services for non-human voice dialog or non-live communication.
Restrict or inhibit other Users or persons from using the Services or the Internet.
Use another provider’s services to engage in prohibited activities through a Service Provider account.
Network Security
Users may not violate the security of the Service Provider’s network, which may result in criminal or civil liability. Service Provider may investigate reported, uncovered, or suspected violations and cooperate with law enforcement, and Users agree to cooperate with such investigations. Service Provider may, without prior notice, monitor content, traffic patterns, perform vulnerability tests, or quarantine servers or accounts to prevent prohibited conduct or protect network security. Such actions may include testing mail or Internet servers for unauthorized third-party relaying. Service Provider will use commercially reasonable efforts to minimize adverse effects on the Services. Users must correct system vulnerabilities upon notification and suspend or terminate compromised systems as required.
Content
“Content” includes any communication or information generated, stored, cached, copied, published, transmitted, or used by Users through the Services, including websites, software, data, documents, photographs, videos, and messages. Service Provider does not claim ownership of User Content and assumes no responsibility for it. Users are solely responsible for the custody, possession, control, and security of their Content and may not use the Services to download, publish, distribute, or copy Content protected by copyright law without authorization. Service Provider does not edit or censor User Content but reserves the right to remove Content, disable sites, or suspend/terminate Services if it determines, in its sole discretion, that Content or User practices are harmful, offensive, or violate laws, the Service Agreement, or this AUP.
Violations, Investigation, and Enforcement
Users must adhere to this AUP. Service Provider may, but is not obligated to, enforce this AUP through all legal means. Violations may result in warnings, followed by suspension or termination of Services if the violation persists. Service Provider may immediately suspend or terminate Services without notice if it reasonably determines a violation exposes Service Provider to civil or criminal liability or disrupts the network. Repeated violations by a User may lead to immediate termination. Service Provider may investigate fraud or other violations and cooperate with legal authorities, including disclosing User identities. Service Provider may access and disclose User information (including transactional data) for lawful purposes, such as responding to emergencies, complying with legal requirements (e.g., subpoenas), protecting Service Provider’s rights or property, or preventing fraudulent or unlawful use. Indirect or attempted breaches of this AUP by third parties on behalf of a User are considered breaches by the User.
Disclaimer of Warranties and Liability
Users are solely responsible for any damage to their systems or data loss resulting from material accessed through the Services. All Content and information accessed through the Services are provided “as is,” “with all faults,” and “as available.” Service Provider, its officers, directors, shareholders, subsidiaries, employees, affiliates, agents, and licensors do not warrant the availability, accuracy, completeness, non-infringement, merchantability, or fitness for a particular purpose of any Content or information. Users access such Content at their own risk. Service Provider does not guarantee error-free, continuous, or virus-free Services. Service Provider, its officers, directors, shareholders, subsidiaries, employees, affiliates, agents, and licensors are not liable for any damages arising from the use of the Services, including compensatory, special, direct, indirect, consequential, or punitive damages, loss of data, income, profit, business opportunities, or property damage, even if foreseeable. The aggregate liability of Service Provider and its affiliates for any claim related to the Services will not exceed $100.00. In jurisdictions where certain liability limitations are not permitted, liability is limited to the fullest extent allowed by law.
Governing Law
This AUP is governed by the laws of the state of Service Provider’s registered office, excluding conflict of law principles. Users irrevocably submit to the exclusive jurisdiction of state or federal courts in the city and county of Service Provider’s registered office for any action arising from this AUP, waiving objections to venue or jurisdiction. Users are responsible for ensuring compliance with all applicable laws, rules, and regulations.
Indemnification
Users agree to indemnify, defend, and hold harmless Service Provider, its officers, directors, employees, agents, affiliates, shareholders, subsidiaries, licensors, and suppliers from all claims, liabilities, losses, expenses, damages, and costs, including reasonable attorneys’ fees, arising from: (1) violations of this AUP; (2) violations of third-party rights; (3) violations of applicable law; (4) User Content; or (5) User’s use of the Services.
Privacy Policy
Service Provider’s Privacy Policy at https://startechitsolutions.com/privacy-policy is incorporated into this AUP.
Miscellaneous
Service Provider’s failure to enforce any provision of this AUP does not constitute a waiver. Neither party’s conduct nor trade practices modify this AUP. Service Provider may assign its rights and duties under this AUP without notice. If any provision is unenforceable, the remaining provisions remain in effect.
